What Should I Know Before Buying a Waterfront Home With a Boat Dock in Huntington Beach?

Title card for the article: What Should I Know Before Buying a Waterfront Home With a Boat Dock in Huntington Beach?

The short answer

What should you know before buying a waterfront home with a boat dock in Huntington Beach? The dock sits over water, so different rules apply than to the house. The City of Huntington Beach permits dock work within its harbor limits, the California Coastal Commission reviews docks seaward of the mean high tide line, and some harbor water is state land that can require a State Lands Commission lease. During escrow, check the permits, any lease and the dock's condition for that specific property.

Why Is a Dock Different From the Rest of the House?

The house sits on land you buy. The dock usually sits over water, and the water area follows its own rules for ownership, permits and leases.

I'm Jeanette Nelson, a REALTOR® with Jeanette Nelson Real Estate, Keller Williams Realty, serving Orange County, Huntington Beach, Costa Mesa, Fountain Valley, and surrounding areas. With a waterfront home, I help buyers build a list of questions about the dock early, so there is time in escrow to get real answers.

This is general information, not legal advice. For questions about leases, permits or title, talk with a real estate attorney and your title company.

Who Owns the Water Under the Dock?

It depends on the location. California Coastal Commission staff reports on Huntington Harbour docks describe two situations:

  • State land administered by the City. One report says that in that area of Huntington Harbour, the water area is owned by the State and administered by the City of Huntington Beach.
  • State land administered by the State Lands Commission. Another report, for a dock on the Main Channel, says that water area is administered by the California State Lands Commission, so a lease from the Commission is required. That lease had its own term and expiration date.

So for any dock, ask: who administers the water here, and is there a lease? If there is, ask for a copy, when it expires, and what is needed for it to continue after the sale.

Who Issues Permits for Docks?

The City of Huntington Beach. The City's Public Works Development Services division handles permitting for harbor dock installation. The City's Harbor Information page covers dock regulations and points to Municipal Code Chapters 13.32 and 13.36.

The California Coastal Commission. Coastal Commission reports explain that although Huntington Beach has a certified Local Coastal Program, a dock seaward of the mean high tide line is within the Commission's retained permit jurisdiction. In those reports, the City's Public Works and Planning reviewed plans and issued an Approval-in-Concept first, then the Commission reviewed the project.

One report adds that an addition or expansion to a floating dock system would need Coastal Commission review and approval. If you plan to change the dock, plan for that review.

What Should I Check for This Specific Property?

Only the records for the property you are buying can answer these, so ask during your investigation period:

  1. Permits. Ask the City for permit records on the dock and any past repairs.
  2. Coastal approvals. Ask whether the dock has a Coastal Development Permit, if one applied.
  3. Leases. Ask whether any part of the dock sits on state land under a lease, and get a copy.
  4. Condition. Hire a qualified marine or dock contractor to inspect floats, pilings, gangway and any seawall or bulkhead. A general home inspector may not cover these.
  5. Boat fit. Measure the slip and water depth against the boat you plan to keep there.
  6. Insurance. Ask your insurance agent how the dock is covered. My article on flood insurance in Huntington Beach explains flood coverage, and my article on the coastal zone explains coastal permits.

For permits in general, my article on unpermitted work explains why records matter before you buy.

Can I Change or Rebuild the Dock Later?

Possibly, with approvals. Coastal Commission reports show Huntington Harbour dock projects that went through City Approval-in-Concept and then Commission review. Each project is reviewed on its own facts, so do not assume a bigger dock will be approved. If a change matters to you, talk to the City and a dock contractor before you remove contingencies.

Frequently asked questions

Do I own the dock when I buy a waterfront home?

Do you own the dock outright? Not always the water under it. Coastal Commission reports show Huntington Harbour water areas owned by the State, administered by the City or the State Lands Commission depending on location.

Who permits dock work in Huntington Beach?

Who permits docks? The City's Public Works Development Services handles harbor dock permits, and the Coastal Commission reviews docks seaward of the mean high tide line.

Does a dock need a state lease?

Does every dock need a lease? Not every one. In areas administered by the State Lands Commission, a Coastal Commission report says a lease from the Commission is required.

Should I get the dock inspected separately?

Should the dock get its own inspection? It's a smart step. A qualified marine or dock contractor can review floats, pilings and the seawall for that specific property.
